    Nevada residents may submit a verified request directing STRUX not to sell certain covered information that STRUX has collected about them.

    STRUX does not currently sell covered information for monetary consideration.

    Depending on the law and whether it applies to STRUX, these rights may include the ability to access, correct, delete, obtain a portable copy of, opt out of certain processing of, or appeal a decision concerning Personal Information.

    STRUX will evaluate verified requests in accordance with applicable law.

    If you are an authorized agent submitting a request on behalf of another person, STRUX may require proof of authorization and may require the consumer’s identity to be verified directly.

    The Site and STRUX programs are intended for adults.

    Because there is no universally accepted standard for interpreting all Do Not Track signals, STRUX does not currently respond to every Do Not Track signal.

    1. Eligibility

    You must be at least 18 years old and capable of entering into a binding agreement to use the Site, enroll in a STRUX program, or purchase any STRUX product or service.

    The Site and STRUX programs are not intended for use by minors unless STRUX expressly provides written permission and a parent or legal guardian has reviewed and accepted all applicable terms.

    2. General Fitness Education Only

    STRUX provides general fitness, movement, wellness, and educational content.

    STRUX content is not medical care, medical advice, diagnosis, treatment, rehabilitation, physical therapy, psychotherapy, nutrition therapy, prescription guidance, or individualized health counseling.

    Use of the Site does not create a physician-patient, physician assistant-patient, therapist-patient, dietitian-client, trainer-client, or other healthcare-provider relationship between you and STRUX or any Company Party.

    No Company Party is acting as your personal healthcare provider through the Site, emails, videos, downloadable materials, social-media content, or self-guided programs.

    You should not use STRUX content to diagnose, treat, cure, prevent, manage, or delay seeking care for any medical condition, injury, symptom, or health concern.

    3. No Emergency Services

    STRUX does not provide emergency services.

    Do not use the Site, a STRUX program, an email response, or social-media content for an urgent medical issue or emergency. If you believe you are experiencing an emergency, call 911 or seek immediate medical care through local emergency services.

    4. Your Responsibility for Participation

    You are solely responsible for deciding whether any STRUX movement, workout, exercise, stretch, breathing practice, nutritional concept, or recommendation is appropriate for you.

    Before beginning or continuing any exercise or wellness program, consider consulting a qualified healthcare professional, particularly if you are pregnant, postpartum, have a chronic condition, have had a recent illness, surgery, injury, or hospitalization, use prescription medication, have been advised to limit activity, or have any concern about your ability to participate safely.

    You agree to use good judgment and to stop participating immediately if you experience pain, dizziness, fainting, chest discomfort, unusual shortness of breath, loss of balance, weakness, numbness, or any other concerning symptom.

    You are responsible for creating and maintaining a safe exercise environment, including appropriate flooring, footwear, equipment, space, lighting, supervision, and exercise intensity.

    5. Assumption of Risk

    Physical activity and exercise carry inherent risks, including but not limited to falls, strains, sprains, overexertion, aggravation of existing conditions, cardiovascular events, and other injuries.

    By voluntarily using STRUX content or participating in any STRUX exercise, movement practice, program, video, challenge, guide, or activity, you knowingly and voluntarily assume all risks associated with your participation.

    To the fullest extent permitted by law, you release and hold harmless the Company Parties from claims, demands, causes of action, damages, losses, costs, and expenses arising from or related to your voluntary use of STRUX content or participation in STRUX activities.

    This release does not apply to claims arising from gross negligence, willful misconduct, or any liability that cannot legally be waived.

    6. No Guarantee of Results

    Results vary from person to person.

    STRUX does not guarantee any particular physical, emotional, medical, athletic, financial, lifestyle, or other result from using the Site, reading content, completing a program, following a routine, or purchasing a product.

    Testimonials, examples, transformations, reviews, and stories are individual experiences. They are not guarantees, promises, or representations that you will achieve similar results.

    7. Accounts, Registrations, and Communications

    You agree to provide accurate, current, and complete information when signing up for STRUX content, newsletters, programs, or services.

    You are responsible for maintaining the confidentiality of any account credentials or access links provided to you.

    You may not share paid program access, download links, login credentials, or member-only materials with any other person unless STRUX expressly authorizes it in writing.

    By signing up for a STRUX program or guide, you agree to receive the communications reasonably necessary to deliver that program or guide.

    Separate marketing communications may be sent only as permitted by applicable law and subject to your communication preferences and unsubscribe rights.

    8. Purchases, Pricing, and Refunds

    If STRUX offers paid products, programs, memberships, downloads, courses, or services, the applicable price, payment terms, access details, refund policy, cancellation policy, and any material restrictions will be presented before purchase.

    You agree to pay all amounts due at the time of purchase.

    STRUX reserves the right to change prices, modify offerings, discontinue products, or limit availability at any time. Changes will not affect purchases already completed unless otherwise stated at the time of purchase.

    All Site content is owned by or licensed to STRUX and is protected by applicable intellectual-property laws.

    You may not remove copyright notices, trademarks, branding, watermarks, or proprietary markings from STRUX content.

    You retain ownership of your original submission. However, you grant STRUX a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, publish, and distribute the submission for business, marketing, educational, or promotional purposes.

    STRUX will not use a personally identifiable testimonial, image, or story in marketing without obtaining appropriate permission.

    Do not submit confidential medical information, protected health information, emergency concerns, or private information you do not want STRUX to possess.

    TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY PARTIES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION.

    STRUX DOES NOT WARRANT THAT THE SITE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, CURRENT, OR FREE FROM ERRORS, VIRUSES, OR OTHER HARMFUL COMPONENTS.

    14. Limitation of Liability

    TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, STRUX CONTENT, OR ANY STRUX PRODUCT OR SERVICE.

    TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF THE COMPANY PARTIES FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE, STRUX CONTENT, OR A STRUX PRODUCT OR SERVICE WILL NOT EXCEED THE GREATER OF:

    1. THE AMOUNT YOU PAID TO STRUX FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE CLAIM; OR

    2. ONE HUNDRED U.S. DOLLARS ($100).

    Nothing in these Terms limits liability that cannot legally be limited or excluded.

    15. Indemnification

    To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Company Parties from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

    • Your violation of these Terms;

    • Your misuse of the Site or STRUX content;

    • Your participation in STRUX activities contrary to these Terms or the Medical / Fitness Disclaimer;

    • Your violation of another person’s rights; or

    • Content or information you submit to STRUX.

    This obligation does not apply to claims caused by a Company Party’s gross negligence, willful misconduct, or conduct that cannot legally be waived.

    16. Governing Law and Venue

    These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except where mandatory consumer-protection law provides otherwise.

    Any dispute arising from or relating to these Terms, the Site, or STRUX content shall be brought exclusively in the state or federal courts located in [County], Nevada, unless applicable law requires a different forum.

    You consent to personal jurisdiction and venue in those courts.

    Nothing in this section limits rights that cannot legally be waived under applicable law.
